It important to remember that The Technical and Vocational Educational Training-(TVET) Act 2013 transferred the Technical Training functions from the Teacher Service Commission to the Ministry of Education Science and Technology.
The public service commission approved the transfer of service of lectures in Polytechnics, Technical Institutes and Vocational Training to the ministry of education, state department for Vocational and Technical Training Institutions with effect from 1st July 2018.
To this end a total of 3780 lectures and institutions administrators who were on TSC payroll as at 30th June 2018, will have their services transferred to the ministry of Education, state Department for Vocational and Technical Training under Public Service with effect from 1st July 2018.
However to ensure smooth transition and an efficient management of the payroll and in view of the existing Collective Bargaining Agreement with the teachers’ unions, the commission shall retain the affected lectures on its payroll up to 31st August, 2018.
Consequently, with effect from 1st September, 2018, the remuneration of the lectures shall be paid by the department of the Vocational and Technical Training.
The lectures who shall retire by 31st August, 2018 will have their retirement benefits processed by TSC. Those retiring/existing the service with effect 1st September, 2018, will be processed by the Ministry of Education, State Department Training and Technical Training.
Discipline Issues of TVET Lecturers
All new cases of teacher indiscipline and professional related matters shall be handled by respective Institution Board of Management (BOMs) then escalated to the Principal Secretary/Authorized Officer as provided for in the law.
Transfer Within TVET Institutions
All requests for transfer within TVET have been deferred until 1st September, 2018.
TVET Tutors Medical Cover
Lectures in the affected institutions will continue to benefit from the current Medical and Health negotiated between TSC and Minet (Kenya) Ltd up to and including 30th August, 2018.
Lectures Not in TSC Payroll as at 1/7/2018
Any lecturer who is not on TSC payroll owing to interalia a pending disciplinary process, unpaid study leave or any other reason will be expected to immediately report to TSC to initiate the process of transfer of service.
In this regard, lectures with any particular concerns are advised to contact TSC or the Department of Technical Training and Vocational Education Training (MOE).
Request for transfer to the Ministry of Education by Teachers not in TVET Institutions
The commission is not handling any request to transfer to the public service commission or the Ministry of Education. Those who wish to join the Ministry from TSC other than those currently deployed to TVET Institutions will be expected to apply when they are advertised by Public Service Commission. The provisions of transfer of service as provided for in the Code of Regulations of teachers will continue to apply.
